Requirements for Contracting with PSU Facilities & Planning
***All vendors, contractors and consultants who do business with Portland State University MUST BE LICENCED TO DO BUSINESS IN THE STATE OF OREGON.
CCB# - All Contractors must be members in good standing of the Oregon Construction Contracting Board and provide the CCB number upon request.
Bid Bond/Bid Security - Bid security is required for all Construction contract bids over $50,000, or as directed in pre-bid documents on a project by project basis.
BOLI Any Contract associated with a Project that exceeds $50,000 in total is subject to Oregon Bureau of Labor and Industries ("BOLI") Prevailing wages. Please read pre bid documents carefully to find out if the contract you are bidding on is part of a BOLI project.
Davis Bacon Any Contractor awarded a Project that receives any portion of funding from the US Federal Government is required pay US Department of Labor determined prevailing wages or local State Labor and Industries determined prevailing wages which ever is higher as mandated by the Davis-Bacon Wage Act.
Affirmative Action - According to Board of Higher Education Requirements (OAR 580-050-0040) all contractors and consultants for projects over $50,000 are required to document that they have made good faith efforts to subcontract or establish joint ventures with or obtain materials to be used in performing the contract from minority, women and emerging small business enterprises.
Performance & Payment Bonds - Performance and Payment Bonds are required for all construction contracts over $100,000.
Retainage
Retainage will automatically be held on any contract in excess of$1,000,000. PSU reserves the right to hold retainage on any project. Retainage is generally 5% of contract total.
Insurance
Insurance minimums provided here reflect the minimum amount of insurance a project could require according to various regulations. Some projects have higher minimum insurance requirement than stated here. Be sure to examine pre-bid documents and contracts closely. At all times, the Institution must have a valid Certificate of Insurance (with policy dates that have not expired) as evidence that the insurance is in force. The contractor must ensure that renewal Certificates of Insurance are forwarded to the Institution prior to the expiration date(s) on the Certificates.
To meet insurance requirements, all Insurance Certificates must:
1)Contain policy numbers on the Certificate(s) and any endorsements or attachments affixed to the Certificate.
2) Show the beginning and ending dates for all policies.
3) Be issued by a company licensed to do business in Oregon.
Automobile liability:
1) Contain auto liability with minimum limits of $1,000,000 per occurrence.
2) If coverage does not include all autos (owned, non-owned, and hired) contractor must provide written certification to the Institution that only covered autos will be used for the contract. If it becomes necessary to use non-covered autos, coverage must be purchased as required by the contract and a Certificate of Insurance must be forwarded to the Institution prior to such use.
General liability:
1)Commercial general liability with minimum limits of $1,000,000 per occurrence.
2) Comprehensive general liability must include Broad Form CGL endorsement.
3) Include as additional insured on a separate endorsement "The State of Oregon, acting through the Oregon State Board of Higher Education, on behalf of Portland State University, its officers and employees."
4) If the "Claims Made" form of insurance is utilized, the contractor shall certify that "Tail Coverage" will be provided if such insurance is cancelled, non-renewed, or not replaced in like form. This is to cover claims made up to twenty-four (24) months following work acceptance.
5) Contain workers' compensation insurance or a signed and dated independent contractor certification statement (form CO-325) from the contractor.
Floater
If the base value of the construction contract at the time of award is $50,000 or more, either builder's all-risk insurance or installation floater is normally required (refer to actual contract award). When this coverage is required, these policies on the Certificate of Insurance must:
1) Be equal to or greater than the full amount of the contract.
2) Contractor shall be financially responsible for any deductible applied to loss.
3) Name the “State of Oregon, acting through the State Board of Higher Education, on behalf of the (university), their officers and employees,” as an additional insured on a separate endorsement.
Pollution Insurance:
Pollution Liablity Insurance of at least $1,000,000 is required for all asbestos abatement work on campus reguardless of contract amount. PSU also reserves the right to require Pollution Liablity Insurance for any other work deemed potentially hazardous to the health and safety of campus or to the surrounding environment.
Professional Liablity Insurance:
All Professional Consultants are required to provide a copy of their Professional Liablity Insurance (also known as "Errors and Omissions Insurance") of $1,000,000.
